Terms of Service

The terms that govern your use of Mistol.

These Terms of Service ("Terms") govern your access to and use of Mistol's products, services, and applications (collectively, the "Services"), including our website, the Mistol workspace application, and our personal-AI service delivered over SMS and iMessage.

By using Mistol, you agree to these Terms.

If you do not agree, do not use the Services.

1. Who We Are

Mistol ("Mistol," "we," "us," or "our") is a Canadian company based in Calgary, Alberta. We provide an AI assistant that individuals and businesses can use as a personal AI in their text messages, as a workspace for projects and tasks, or both.

2. Eligibility

You must:

  • Be at least 18 years old
  • Have the authority to enter into these Terms
  • Use the Services in compliance with applicable laws

If you are using Mistol on behalf of a company, you agree to these Terms on behalf of that organization.

3. Your Account

You are responsible for:

  • Maintaining the confidentiality of your account
  • All activity under your account, including messages sent from your phone number
  • Providing accurate and up-to-date information

You agree not to share access in a way that violates your plan or these Terms.

4. What Mistol Does

Mistol provides AI-powered tools that:

  • Respond to your text messages over SMS and iMessage as a personal AI
  • Remember context across conversations using long-term memory
  • Process voice notes, screenshots, and images that you send
  • Organize tasks, projects, and content within the workspace
  • Execute actions through connected tools such as Gmail, Google Calendar, and Outlook (with your permission)

Mistol is designed to assist you, not to replace human judgment.

5. User Content

You retain ownership of all content you submit, upload, send by message, or generate using Mistol ("User Content").

By using the Services, you grant Mistol a limited license to:

  • Process your content (including messages, voice notes, and images)
  • Store and display it
  • Use it solely to provide and improve the Services

We do not sell your content and do not use your data to train external public AI models.

6. AI Limitations

Mistol uses artificial intelligence to assist with tasks. You understand and agree:

  • Outputs may not always be accurate or complete
  • You are responsible for reviewing and approving outputs
  • Mistol is not liable for decisions made based on AI-generated content

7. Acceptable Use

You agree not to use Mistol to:

  • Violate any law or regulation
  • Infringe on intellectual property rights
  • Upload, transmit, or process harmful, abusive, or illegal content
  • Send unsolicited bulk messages or use the Services to spam others
  • Attempt to reverse engineer or disrupt the platform
  • Access or use data that you do not have permission to use

We may suspend or terminate accounts that violate these Terms.

8. Integrations & Third-Party Services

Mistol may connect with third-party tools (e.g., Gmail, Google Calendar, Outlook). You acknowledge:

  • You control what integrations are connected
  • Third-party services are governed by their own terms and policies
  • Mistol is not responsible for third-party actions or data handling

9. Plans, Free Trial & Payments

Mistol offers a Free plan that includes 14 days of unlimited use without a credit card, and a paid Solo plan ($19.99/month at the time of writing).

If you subscribe to a paid plan:

  • Fees are billed in advance on a recurring monthly basis until you cancel
  • You authorize us to charge your payment method for each billing cycle
  • Payments are non-refundable unless required by law
  • Pricing and plan contents may change; we will give reasonable notice of material changes before they affect your next renewal

When the 14-day Free trial ends, your account will continue at the Free tier with reduced features. You will not be automatically charged unless you have separately chosen a paid plan and provided a payment method. You may cancel at any time; access continues until the end of the billing period.

10. Messaging Services (SMS / iMessage)

By providing your phone number to Mistol — including by texting our number, entering your phone number during signup, or otherwise opting in — you consent to receive text messages from Mistol at that number. Message frequency varies based on your usage. Message and data rates may apply from your carrier.

You can stop messages at any time by replying STOP, and you can request help by replying HELP. We do not share opt-in information or mobile phone numbers with third parties for their own marketing. Carriers are not liable for delayed or undelivered messages.

11. Termination

You may stop using Mistol at any time. We may suspend or terminate access if:

  • You violate these Terms
  • Your use poses a risk to the platform or others
  • Required by law

Upon termination, your access to the Services will end.

12. Data & Privacy

Your use of Mistol is also governed by our Privacy Policy. Key points:

  • Your data is processed by Mistol and a defined set of sub-processors disclosed in our Privacy Policy
  • We do not sell your data
  • Your data is used to operate the Services, not to train external public AI models

13. Service Availability

We aim to provide reliable Services, but we do not guarantee:

  • Continuous, uninterrupted access
  • Error-free operation
  • Timely delivery of every SMS or iMessage (delivery depends on carriers and other third parties)

We may modify, suspend, or discontinue features at any time.

14. Disclaimer of Warranties

Mistol is provided "as is" and "as available." We do not guarantee that:

  • The Services will meet all your expectations
  • Outputs will be accurate or suitable for your specific needs

Use of the Services is at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law, Mistol will not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities

Our total liability will not exceed the amount you paid to Mistol in the 12 months prior to the claim.

16. Indemnification

You agree to indemnify and hold Mistol harmless from claims arising out of:

  • Your use of the Services
  • Your User Content
  • Your violation of these Terms

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via:

  • Email
  • In-app or in-message notification
  • Website update

Continued use of the Services means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
